| Making A Purchase The terms and conditions set out below apply to all transactions on this website. Please read them carefully as use of this website and all orders placed assume acceptance of them. (1) Only when your order has been dispatched, has your order been accepted, unless we have previously informed you that we do not accept you order or you have cancelled it. Your order may not be accepted if the item is unavailable, if your payment is not authorised, if we have reason to believe the transaction is fraudulent or suspicious or a product is priced or described wrongly. (2) Goods are subject to availability. In the event that we are unable to supply the goods we will inform you of this and your options as soon as possible. You will not be charged if goods are unavailable. (3) We cannot guarantee that the colour shades or textures depicted in our photos are exact or accurate due to the unique nature of our products and the limits of photographic technology and video card and monitors. However we do offer a no-risk guarantee should you not be happy. (4) You have the right to cancel the contract for the purchase of any unused item within 7 days of delivery as set out in the UKs Distance Selling Regulations. This excludes custom made or personalised items e.g. all our saddles are specially ordered and made to your specific design and/or template. (5) You may cancel your order if it has not yet been shipped by us. You may not cancel an order for a custom made item e.g. a saddle, once it has entered manufacture. (6) Any items which are returned for reasons other than being of faulty manufacture and beyond the 7 days stipulated by the Consumer Protection (Distance Selling) Regulations 2000 may incur a charge of 25% handling costs and will only be accepted provided they are returned in the same condition in which they were delivered. (7) Payments are made in Pounds Sterling. Exchange rates shown are intended for guidance only and conversions are made at our credit card processing banks prevailing rate at the time the payment is taken from your card. (8) Whilst we endeavour to provide accurate prices and descriptions, errors may occur. If we discover an error in the price or description of the goods you have ordered we will notify you and give you the option of reconfirming or cancelling your order. (9) Your acceptance of delivery requires a signature by an adult over the age of 18. (10) Every effort is made to deliver your goods within the estimated time scales. From time to time delays may occur. We will not be held liable for any failed or late deliveries. (11) Deliveries outside the European Union may incur local taxes and import duties, which may involve slight delays. The customer is solely responsible for the payment of any of these additional charges that may be imposed. (12) Better Saddles Ltd is not registered for UK VAT. (13) Our credit card processing bank carries out rigorous security checks on all credit and debit card transaction. Should we feel that an order is suspicious or where the details provided do not match the details held by the card issuing bank, we reserve the right to refuse it. (14) We will take all reasonable precautions to keep the details of your order and credit card secure. However, we cannot be held liable for any losses caused as a result of unauthorized access to your information, unless we are negligent. (15) We reserve the right to change these terms and conditions without notice to you. (16) The contract between us shall be governed by the Law of England and the English courts shall have exclusive jurisdiction. If any one or more of these terms shall be found to be illegal, invalid or unenforceable, the legality, validity and enforceability of the remaining terms shall not be affected or impaired. |
| Delivery Schedule For most packages we use the services of the Royal Mail to deliver your goods within the UK. Some heavy or bulky products may need an extra delivery charge but that will be shown in the product information. For international deliveries we would generally use airmail for smaller items and a courier service for larger items - the shop software will calculate the delivery charge according to package weights and destination. Please note that customers living outside the European Union may incur local taxes and import duties, which may involve slight delays. The customer is solely responsible for the payment of any of these additional charges that may be imposed. When you make your payment online the processing of your order can start immediately. If you send in a cheque, we have to wait for it to arrive - and clear. Depending on the availability of the products you wish to buy, we either dispatch them to you immediately, wait for them to arrive from a supplier or, when ordering custom-made goods, place an order on your behalf. Each of those will have its own order processing time, which can be anything from same day to 45 days if the item is custom-made e.g. a bespoke saddle. While Royal Mail makes next working day delivery often possible in the most of the UK, it may take up to 4 days for a parcel to be delivered to remote parts of the country (e.g. Orkney Islands). As a guideline, please allow 7-28 days for delivery - more for custom-made goods and not easily accessible parts of the world. We would expect, however, that for in stock items you should receive them within 5 working days in the UK. Should there be a significant delay in processing your order, we will contact you for instructions. |
| Back Orders If your item is not in stock, we will back order for you. You will always be emailed with the option to cancel your order if you would rather not wait. |
| Credit Card Security If you choose to pay by Credit or Debit Card, just select the WorldPay payment option when you complete the order form. You will need to provide the 3-digit security code on the back of the card and an issue number for Maestro and Solo cards. Your card details will be taken once you reach the secure payment page so that you can submit your details in complete confidence. We process your credit cards via RBS WorldPay - a leading payment processor recommended by UK banks. If you don't want to send your card details via our secure payment page you can submit them over the telephone or fax using the contact details listed above. We reserve the right to insist on a Bank Transfer of funds before shipment of goods or you can choose this method yourself. |

| Returns Policy We offer a no-risk guarantee, so if you are not entirely happy with your purchase for any reason we will gladly refund the purchase price of the items, provided that you have first notified us and they are returned within 7 days of receipt. All products must be returned in a new, resellable condition. Damaged, marked or stained goods CANNOT be returned. Items which could not be resold due to health/hygene considerations cannot be refunded. Software, CD's or other recorded material CANNOT be returned if opened, except for replacement if the goods are faulty. Custom made or personalised items, which include our saddles, are EXCLUDED from this 7 day returns policy. Please contact us and we will do our best to help you. Better Saddles is not responsible for returned goods lost or damaged in transit. Always attempt to use the original packaging and we would advise on insuring the goods with your courier. We will replace any defective item with an identical one whenever possible. If the item you bought is obsolete or unreplaceable you will be offered an exchange option or a refund. In order to keep costs down for all customers we will not refund our original postage costs or the cost of return postage unless the products are faulty or we have made an error in what we've sent to you. If you are returning items from outside the UK, please mark clearly on the packaging and the customs declaration that you are returning the goods to the retailer/manufacturer. This should normally help to ensure further custom charges are not incurred. Any customs charges and/or postal charges incurred through a failure to follow the above returns procedure and/or providing adequate postage will be deducted from your refund. After 7 days we reserve the right to charge a 25% handling fee for restocking a returned item. |
